What to look for in the results:
LIVE — active mark, read carefully
DEAD — lapsed/abandoned (lower risk, but not zero)
Pending — application filed, not yet registered
  • Check the Goods and Services description — trademarks are class-specific. A mark for candles doesn't block you from using the same name for digital downloads.
  • Check the status. DEAD marks have lapsed protections, though common-law rights may still apply.
  • Look at the mark itself — exact matches are clearest, but similar-sounding or -looking marks can also infringe.
  • If you find a LIVE mark in your goods category with a similar name, rename before listing. It's far easier than a takedown dispute.

Can I get in trouble on Etsy for using a trademarked name?

Yes. Etsy complies with trademark law and processes IP complaints. Rights-holders — including large brands and small business owners — file notices that can result in listing removal or account suspension, even if you weren't aware of the trademark. A 5-minute check costs nothing.

What does it mean if my name appears in USPTO records?

It means someone has applied for or registered a trademark. Read the Goods and Services description carefully — a LIVE mark for cosmetics doesn't automatically block you from using the same name for wooden toys. But similar-class matches are a real risk. When in doubt, pick a different name or consult an attorney.

What's the difference between LIVE and DEAD status?

LIVE means the registration or application is active and being maintained. DEAD means it has expired, been abandoned, or cancelled — the formal registration is gone, but the original owner may still hold common-law rights if they've been using the mark in commerce.

What if there are no results?

No USPTO match is a good sign, but it's not a guarantee. Some older rights aren't registered (common-law trademarks). Also try searching variations of your name (plural, with spaces vs. without).

Should I trademark my own Etsy shop name?
